Do i have the right to return motorcycle to the private seller claiming my money back, if i am not satisfied?
i bought a used motorbike from a private seller (not commercial)in melbourne (australia), i am not satisfied with the bikes performance, do i have the legal rights to claim my money back from him? Where should i go for help?

- The only way to get your money back is if he lied to you about the bike. If he told you something that was not true. However, you will have to take him to court, and you'll probably not win b/c it will be his word against yours. Good luck.
- You purchased the bike. If he lied to you about it, you might have a case, but, it will be hard to fight. And you should have tested it out thoroughly before you paid for it to begin with.
- when you buy used its pretty much understood you bought it as-is. if you're not satisfied with the performance, thats your fault for not test riding. but since you just bought it, and its used, there should be no reason you couldn't sell it to someone else for about the same price. you might lose a little on it, but you might make a small profit. either way, you learned from it, and will have a better idea of what you want when you buy the next one
- Probably not, unless the motorcycle is defective and you can prove the seller concealed this from you. Even then it has always been Buyer Beware.
- In many cases when buying a car or a motorcyclc from a private owner, its buyer beware because there is no express warranty as you might have from a dealer. At times the private owner will have you sign some form of document that states sold as is. If this happen in your case then there is no recourse to get back your money. If you think that a fraud has been committed in the sale, then the next thing to do is take the matter to a small claime court. Good Luck
- This is why I tell people to add a sentence to the bill of sale stating moneyback upon defect or other circumstances for a certain time period. All you really could do is ride a crappy bike or unload it to some unsuspecting guy like he did you.
- Let the buyer beware. In other words u lose.
- In the states only if there was fraud. This is the risk of buying from a casual seller. Sorry, don't know about AUZ but probably the same I would think.
